Terms and Conditions for Accommodation Agreement

Article 1. Scope of Application

  1. Accommodation contracts and related agreements to be entered into between this Hotel and the Guest shall be subject to these Terms and Conditions. Any particulars not provided herein shall be governed by laws and regulations and/or generally accepted practices.
  2. If the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices, the special contract shall take precedence over the provisions of these Terms and Conditions notwithstanding the preceding paragraph.

Article 2. Request for Accommodation Agreement

  1. When the Guest requests an accommodation contract with the Hotel, the Guest shall notify the Hotel of the following information:
    1. Name of the Guest(s);
    2. Stay dates and estimated time of arrival;
    3. Accommodation charges (based, in principle, on the basic accommodation charges listed in the attached Table No. 1); and
    4. Other information deemed necessary by the Hotel.
  2. If the Guest requests, during his/her stay, an extension of stay beyond the stay dates in subparagraph (2) of the preceding paragraph, it shall be regarded as a request for a new accommodation contract at the time such request is made.

Article 3. Conclusion of Accommodation Agreement

  1. The accommodation contract shall be deemed to have been concluded when the Hotel has duly accepted the request as stipulated in the preceding article. However, the same shall not apply if it has been proved that the Hotel has not accepted the request.
  2. When the accommodation contract has been concluded under the provisions of the preceding paragraph, the Guest is requested to pay a deposit set by the Hotel within the limit of basic accommodation charges for the period of stay (3 days when the period of stay exceeds 3 days) by the date specified by the Hotel.
  3. The deposit shall first be applied for the final accommodation charges to be paid by the Guest, then secondly for the cancellation fees under Article 6, and thirdly for the compensation of damages under Article 18, if applicable. Any remaining amount shall be refunded at the time of payment of the accommodation charges as stipulated in Article 12.
  4. If the Guest has failed to pay the deposit by the date stipulated in paragraph 2, the accommodation contract shall cease to be effective. However, this shall apply only if the Hotel has notified the Guest of this provision when specifying the date for payment.

Article 4. Special Contracts Requiring No Deposit

  1. Notwithstanding the provisions of paragraph 2 of the preceding article, the Hotel may enter into a special contract that does not require a deposit after the contract has been concluded as stipulated in the same paragraph.
  2. If the Hotel has not requested the payment of the deposit as stipulated in paragraph 2 of the preceding article and/or has not specified the date of the payment of the deposit when the request for the accommodation contract has been accepted, it shall be treated as though the Hotel has accepted a special contract prescribed in the preceding paragraph.

Article 4-2 Request for cooperation in infection prevention measures at the facility

  1. Our hotel may request that guests who wish to stay at our hotel cooperate with the provisions of Article 4-2, Paragraph 1 of the Hotel Business Act (Act No. 138 of 1948).

Article 5 Refusal to Enter into an Accommodation Contract

  1. The Hotel may refuse to enter into an accommodation contract in the following cases. However, this paragraph does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Inns Hotel Business Act.
    1. When the application for accommodation does not comply with these terms and conditions.
    2. When the hotel is fully booked and there are no rooms available.
    3. When it is deemed that the person requesting accommodation is likely to act in a manner that violates the provisions of law, public order, or good morals in relation to his/her stay.
    4. When it is deemed that the person requesting accommodation falls under any of the following items (a) to (c).
      • (a) When the person requesting accommodation is a member of an organized crime group, a member of an organized crime group, an organization or person related to an organized crime group, or another antisocial force.
      • (b) When the person requesting accommodation is a corporation whose business activities are controlled by an organized crime group or a member of an organized crime group, or another organization of antisocial forces.
      • (c) When the person requesting accommodation is a corporation whose executive officer is a member of an organized crime group, or another organization of antisocial forces.
    5. When a person requesting lodging behaves in a manner that significantly inconveniences other guests.
    6. When a person requesting lodging is a patient of a specific infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Hotel Business Act (hereinafter referred to as “patient of a specific infectious disease”).
    7. When violent demands are made in relation to lodging or when a burden beyond reasonable limits is demanded. (Except when a person requesting lodging requests the removal of social barriers as defined in Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on Promotion of Elimination of Disability Discrimination (Act No. 65 of 2013, hereinafter referred to as “Disability Discrimination Elimination Act”).)
    8. When lodging is not possible due to natural disasters, facility malfunctions, or other unavoidable reasons.
    9. When the person requesting accommodation is deemed to be a nuisance to other guests due to excessive intoxication or extremely abnormal speech and behavior, or when the case falls under the provisions of the Shizuoka Prefecture Hotel Business Law Enforcement Ordinance.
    10. When the person requesting accommodation is deemed to be a nuisance to other guests due to extremely dirty body or clothing.
    11. When the person requesting accommodation is clearly unable to pay.
    12. When the person requesting accommodation has brought or is attempting to bring in dangerous objects, prohibited items, or other items that may be a nuisance to guests.

Article 5-2 Explanation of Refusal to Enter into Accommodation Contract

  1. When the Hotel refuses to enter into an accommodation contract based on the previous article, the person requesting accommodation may request an explanation of the reason from the Hotel.

Article 6. Guest’s Right to Cancel Accommodation Agreement

  1. The Guest may cancel an accommodation contract by making a request to the Hotel.
  2. If the Guest has canceled an accommodation contract in whole or in part due to reasons attributable to the Guest (except when the Hotel has requested the payment of the deposit during the specified period as prescribed in paragraph 2 of Article 3 and the Guest has canceled before the payment date), the Guest shall pay cancellation fees as listed in the attached Table No.2.
  3. If the Guest does not arrive at the hotel by 8:00 p.m. on the arrival date (or 2 hours after the time indicated, if the time is specified in advance), the Hotel may deem the accommodation contract to have been canceled by the Guest.

Article 7 Right of the Hotel to Cancel the Contract

  1. The Hotel may cancel the accommodation contract in the following cases. However, this does not mean that the Hotel may refuse accommodation in cases other than those listed in Article 5 of the Hotel Business Act.
    1. When the guest is deemed likely to commit or has committed acts in violation of the provisions of laws and regulations, public order, or good morals in relation to his/her stay.
    2. When the guest is deemed to fall under any of the following items (a) to (c).
      • (a) When the guest is a member of an organized crime group, a member of an organized crime group, an organization or person related to an organized crime group, or another antisocial force.
      • (b) When the guest is a corporation whose business activities are controlled by an organized crime group or a member of an organized crime group, or another antisocial force organization.
      • (c) When the guest is a corporation, whose executive is a member of an organized crime group, or another antisocial force organization.
    3. When the guest behaves in a manner that causes significant inconvenience to other guests.
    4. When the guest is a patient of a specific infectious disease, etc.
    5. When the guest makes violent demands against the hotel or the hotel staff, or when he/she demands an unreasonable burden.
    6. When the guest is drunk or behaving abnormally, and is deemed to be a nuisance to other guests, or when the guest falls under the provisions of the Shizuoka Prefecture Hotel and Inn Business Law Enforcement Ordinance.
    7. When the guest is deemed to be in a state of extremely unclean body or clothing, and is deemed to be a nuisance to other guests.
    8. When the guest smokes in bed, tampers with firefighting equipment, or fails to comply with other prohibited acts (limited to those necessary for fire prevention) set forth in the hotel’s rules of use.
    9. When the guest is clearly deemed to be unable to pay.
    10. When the guest brings in or attempts to bring in dangerous or prohibited items, or other items that may be a nuisance to guests.
    11. When the guest does not comply with the hotel’s rules of use. In addition to the above, when the guest does not comply with the provisions of these terms and conditions.
  2. When the hotel cancels the accommodation contract based on the provisions of the preceding paragraph, the guest will not be charged for any accommodation services that have not yet been provided.

Article 7-2 Explanation of cancellation of accommodation contract

  1. When the hotel cancels the accommodation contract based on the preceding article, the guest may request the hotel to explain the reason.

Article 8. Registration

  1. The Guest shall register the following information at the hotel front desk on the day of arrival:
    1. Name, age, sex, address and contact information of the Guest(s);
    2. Nationality, passport number, date of entry, departure date and scheduled departure time (For foreigners who do not have an address in Japan);
    3. Date and estimated time of departure; and
    4. Other information deemed necessary by the Hotel.
  2. If the Guest is not of Japanese nationality and does not reside in Japan, the Guest’s passport shall be presented and the Hotel will make a photocopy of the passport;
  3. If the Guest intends to pay the charges prescribed in Article 12 by any means other than Japanese currency, such as traveler’s cheques, coupons or credit cards, the Guest must present such payment method in advance at the time of the registration prescribed in the preceding paragraph.

Article 9. Hours of Use of the Guest Room

  1. The Guest may use the guest room from 3:00 p.m. on the day of arrival until noon on the day of departure.
  2. Notwithstanding the provision of the preceding paragraph, the Hotel may accept the use of a guest room after the check-out time stipulated in the preceding paragraph, in which case an additional charge shall be required as specified below.
    1. Up to 1 hour after the check-out time………..10,000 yen
    2. Up to 2 hours after the check-out time………..20,000 yen
    3. Up to 3 hours after the check-out time………..30,000 yen
    4. Daily room charge as determined by the Hotel is required after 3:00 p.m.
  3. *Tax included, service charges not included

Article 10. Observance of Hotel Rules

  • While staying at the Hotel, the Guest shall observe the Hotel Rules established by the Hotel, which are posted within the premises of the Hotel.

Article 11. Business Hours

  1. The hours of operation of the hotel’s main facilities are as follows. However, it may temporarily change due to unavoidable causes. In such a case, the reception shall inform the Guest by appropriate means.

Article 12. Payment of Accommodation Charges

  1. The breakdown of the accommodation charges and other charges to be paid by the Guest is specified in attached Table No. 1.
  2. The accommodation charges and other charges referred to in the preceding paragraph shall be paid at the reception at the time of the Guest’s departure or upon request by the Hotel. The payment shall be made in cash or by other means, such as travelers cheques, coupons, or credit cards, that are accepted by the Hotel.
  3. Once accommodation facilities have been made available by the Hotel, the accommodation charges shall be paid even if the Guest voluntarily chooses not to stay at the Hotel.

Article 13. Liabilities of the Hotel

  1. The Hotel shall compensate the Guest for damages if the Hotel has caused such damages to the Guest in the course of its performance of, or by its non-fulfillment of, an accommodation contract and/or related agreements. However, the same shall not apply if such damage has been caused by reasons not attributable to the Hotel.
  2. The Hotel is covered by Hotel Liability Insurance to deal with unexpected fires and other disasters.

Article 14. Arrangements when Unable to Provide Contracted Rooms

  1. If the Hotel is unable to provide the Guest with the contracted room, the Hotel shall, with the consent of the Guest, arrange other accommodation of the same standard elsewhere.
  2. If the Hotel is unable to arrange other accommodation notwithstanding the provisions of the preceding paragraph, the Hotel shall pay the Guest compensation equivalent to the cancellation fees. Through such payment, the Hotel shall be deemed to have fulfilled its obligation to compensate for the damages incurred by the Guest. However, if the Hotel’s inability to provide accommodation is not the result of a cause attributable to the Hotel, the Hotel will not pay compensation to the Guest.

Article 15. Liability of the Hotel for the Guest’s property

  1. The Hotel shall compensate the Guest for damages caused to the Guest’s property (including the Guest’s property left in the care of the Hotel), only if such damages including loss or breakage were caused intentionally or by gross negligence on the part of the Hotel. If the Hotel is liable for damages, the Hotel shall compensate the Guest for the loss based on the fair market value at the time of loss or up to a maximum of 300,000 yen, whichever is lower.
  2. The Guest is not able to leave valuables such as money, negotiable instruments, jewelry and important documents in the care of the Hotel. However, guests may use the safe in guest rooms. The Hotel shall compensate the Guest for damages caused to the Guest’s property while using the safe up to a maximum of 600,000 yen, only if damages including loss or breakage were caused intentionally or by gross negligence on the part of the Hotel.

Article 16. Handling of Baggage or Belongings of the Guest

  1. If the Guest’s baggage arrives at the Hotel prior to his/her stay, the Hotel shall be liable to keep it only if such a request has been accepted by the Hotel before the arrival of the baggage. The baggage shall be handed over to the Guest at the reception at the time of check-in.
  2. If the Guest’s baggage or personal belongings are left behind at the Hotel after the Guest has checked out, they will be handled in accordance with the Lost Goods Law after being stored for a certain period of time.
  3. The Hotel’s liability in regard to the handling of the Guest’s baggage and belongings in the case of the preceding two paragraphs shall be assumed in accordance with the provisions of the preceding article.

Article 17. Liability in Regard to Parking

  • When the Guest uses the Hotel’s parking lot, the Hotel shall not be liable for the Guest’s vehicle regardless of whether or not the Guest leaves the car key with the Hotel. However, if damages were caused intentionally or by gross negligence on the part of the Hotel in regard to the management of the parking lot, The Hotel shall compensate the Guest for the damages.

Article 18. Liability of the Guest

  • The Guest shall compensate the Hotel for damages caused intentionally or by negligence on the part of the Guest.

Article 19. Disclaimer

  • Use of computer communications from within the hotel shall be at the Guest’s own risk. The hotel shall not be liable for any damages incurred by the Guest as a result of connection interruption due to system failure or any other reason during the use of computer communications. In addition, if the Hotel or a third party incurs damages as a result of the Guest’s conduct which is deemed inappropriate by the Hotel while using computer communications, the Guest shall compensate for the damages.

Article 20. Jurisdiction and Governing Law

  • Any disputes arising out of or in connection with accommodation contracts and/or related agreements under these Terms and Conditions shall be resolved exclusively in the Japanese courts having jurisdiction over the location of the Hotel, in accordance with the laws of Japan.

Article 21. Governing Language

  • These Terms and Conditions are translated into multiple languages. If there is any conflict or inconsistency between versions in different languages, the Japanese version shall prevail.

Note:

  1. The percentage is the ratio of the cancellation fee to the basic accommodation charges. However, for the cancellation of accommodation packages, cancellation fees are calculated based on the full package price.
  2. When the number of days contracted is reduced, a cancellation fee for the first day shall be paid by the Guest regardless of the number of days shortened.
  3. When a part of the accommodation contract for a group of 10 or more guests has been canceled, no cancellation fee will be charged for up to 10% (a fraction to be evened up) of the total number of guests booked as of 10 days prior to the scheduled date of arrival (or the day when the cancellation has been accepted).
  4. In addition, specific accommodation packages or specific groups planned by our hotel may have different cancellation fees than the above provisions.
